Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Postelist website, your application and call booking, the communications we send you, and — unless a separate signed services agreement applies — the Service. Postelist (“Postelist”, “we”, “us”) provides done-for-you private email infrastructure and deliverability services for established senders. Postelist is established in Hong Kong. By using our site, submitting our form, or engaging the Service, you agree to these Terms.

1. The Service

Postelist provides managed, done-for-you email infrastructure and deliverability services. You engage the Service by applying, booking a consultation, and accepting a paid plan or order. Booking a call is not itself a contract for paid Services; paid Services are governed by the specific order, plan, or separate services agreement you accept, which prevails over these Terms to the extent of any conflict for that engagement. We may update, improve, or change the Service over time.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and you must use the Service for business purposes. If you apply on behalf of a company, you represent that you have authority to bind it to these Terms.

3. Applications & bookings

You agree to provide accurate, complete, and current information in your application and at booking. We may qualify, contact, reschedule, or decline any application at our discretion, and may cancel or reassign call slots — for example, in the case of no-shows or apparent false bookings. We reach out across email, SMS, and phone (including an automated pre-call) to confirm and prepare for your call; see Section 4.

4. SMS & call communications & consent

  • What you agree to. When you submit our form, you agree to receive SMS appointment confirmations and reminders from Postelist at the number you provide.
  • Frequency & rates. Message frequency varies with your booking. Message and data rates may apply, depending on your carrier and plan.
  • Opting out. You can withdraw consent and stop the messages at any time by replying STOP to any message, after which we send a single confirmation and then stop. Reply HELP for help, or contact privacy@postelist.com. Opting out of SMS does not cancel your booking or stop email confirmations.
  • Calls may be recorded. Calls with us, including the automated pre-call qualification call, may be recorded and transcribed for quality, qualification, and training. Tell us on the call if you’d prefer not to be recorded.

5. Fees & payment

Paid Services are quoted in the order or plan you accept and are billed through our payment processor, Stripe. The fees, billing frequency, currency, and any deposit or setup amount are as stated at the time of purchase, and taxes may apply. Unless your order or an applicable money-back guarantee says otherwise, fees are non-refundable except where a refund is required by law. You authorize us and our processor to charge the payment method you provide for amounts due.

6. Your responsibilities & representations

You represent, warrant, and agree that:

  • You own, or are authorized to use, the sending domains, lists, and contact data you provide to or route through the Service, and you have a lawful basis to do so.
  • You have obtained any required consents from your recipients and will honour opt-outs and unsubscribe requests.
  • You will comply with all laws governing your sending activity, including CAN-SPAM (United States), CASL (Canada), the UK Privacy and Electronic Communications Regulations (PECR), the EU ePrivacy Directive and GDPR, the Australian Privacy Act and Spam Act, and the Hong Kong Unsolicited Electronic Messages Ordinance (Cap. 593) and PDPO.
  • The information you give us is accurate, and you will keep any credentials you receive secure.

7. Acceptable use

You will not use the Service or our infrastructure to:

  • Send unlawful, deceptive, harassing, or abusive messages, or content that infringes others’ rights.
  • Send to purchased, scraped, or harvested lists without a valid lawful basis and consent.
  • Distribute malware, phishing, or fraudulent content.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with, probe, or attempt to gain unauthorized access to the Service, our systems, or our other clients.

8. Roles & data processing

For the contact and sending data you provide or authorize us to process in delivering the Service, you act as the controller and Postelist acts as a processor on your instructions. That processing is governed by our Data Processing Agreement, which forms part of these Terms. How we handle personal data more generally is described in our Privacy Policy.

9. Intellectual property

We and our licensors own the website, the Service, and all related software, materials, and brand elements. We grant you a limited, non-exclusive, non-transferable right to use them for their intended purpose while these Terms are in effect. You retain ownership of the content and data you provide, and you grant us the rights needed to deliver the Service to you.

10. Disclaimer of warranties

The Service is provided “as is” and “as available”. Email deliverability and inbox placement depend on mailbox providers, your sending reputation, your content, and other factors outside our control, and we do not warrant any particular deliverability, open, reply, or revenue outcome. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, Postelist will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service and these Terms will not exceed the fees you paid to us in the three months before the event giving rise to the claim.

12. Indemnity

You will indemnify and hold harmless Postelist and its personnel from any claim, loss, or expense (including reasonable legal fees) arising out of your content, your sending activity, your use of the Service, or your breach of these Terms or of any law.

13. Suspension & termination

We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, create legal or security risk, or engage in abusive or unlawful sending. You may stop using the Service at any time; provisions that by their nature should survive termination (including fees owed, disclaimers, limitations of liability, and indemnities) will survive.

14. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages at mailbox providers or upstream vendors, network failures, acts of government, or other force-majeure events.

15. Governing law & disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws rules, and you and Postelist submit to the exclusive jurisdiction of the courts of Hong Kong for any dispute, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing in these Terms limits any consumer rights that cannot be waived under the law that applies to you.

16. Changes to these Terms

We may update these Terms from time to time; we’ll revise the date above and, for material changes, take reasonable steps to let you know. Your continued use of the site or the Service after an update means you accept the revised Terms.

17. General & contact

These Terms, together with any order you accept, our Data Processing Agreement, and our Privacy Policy, are the entire agreement between you and Postelist regarding the Service. If any provision is unenforceable, the rest remains in effect; our failure to enforce a provision is not a waiver; and you may not assign these Terms without our consent.
